1. Scope and Application
Generations Obstetrics & Gynecology, P.C. (“Generations,” “we,” “our” or “us”) is committed to protecting your privacy and the confidentiality of your Personal Data (defined below). This Website Privacy Policy (“Privacy Policy”) applies to the website located at https://www.generationsobgynct.com (“Site”), which is operated by Generations.
This Privacy Policy describes how we collect, use, disclose, retain and protect your Personal Data when you browse, view, navigate and/or otherwise use the Site. It does not govern the collection, use or disclosure of your PHI (defined below). If you use the Site, you consent to the collection, use and sharing of information under this Privacy Policy and you agree to our Terms of Use. This Privacy Policy does not apply to information collected through any Third-Party Site or any other services that you may access through our Site.
Nothing in this Privacy Policy replaces or supersedes any other agreement or policy between you and Generations.
2.Definitions
For purposes of this Privacy Policy:
“Personal Data” means information that identifies, relates to, describes or could reasonably be linked with a particular individual, household or device, including but not limited to identifiers such as name, email address, IP address and other online identifiers.
“Protected Health Information” or “PHI” has the meaning given in HIPAA, and generally includes individually identifiable health information that we create, receive, maintain or transmit in providing health care services to Generations’ patients.
Any other capitalized terms used in this Privacy Policy shall have the same meanings provided in the Terms of Use for the Site.
3.Personal Data We Collect
Information Provided by You. While using our Site, you may provide us with certain Personal Data. For example, when you fill out a form, provide contact information, subscribe to email updates or newsletters, respond to a survey or use any AI Service on our Site.
Information Collected Automatically. Generations automatically collects usage and device information when you use our Site, such as IP address, device identifiers, browser type, operating system, device, location, time zone, language, referring URLs, pages viewed, links clicked, dates/times of visits, language, interests, screen size, device type, gender, age, location and other demographic information. We also use cookies, web beacons, pixels, browser fingerprinting, screen recordings via Microsoft Clarity, and similar technologies to operate the Site, remember preferences, analyze site traffic and measure marketing performance. You may control certain cookies and similar technologies through your browser settings; however, disabling cookies may impact Site functionality and performance.
Generations uses reCAPTCHA to protect against spam and other automated abuse by identifying activity from an automated program or artificial intelligence (Ai). reCAPTCHA analyzes the behavior of Site visitors as soon as the Site visit begins. The data collected during this analysis is sent to a Third-Party Site. Data collected includes, but may not be limited to, IP address, date, time, language, screen size or mouse movements. The use of reCAPTCHA is subject to the Third-Party Site’s applicable privacy policy and terms of use.
4.How We May Use Your Personal Data
Service Delivery. To operate, maintain and improve the Site and our services offered through the Site, process requests and communicate with you.
Security and Fraud Prevention. To protect the Site, our users and our practice, and to detect, prevent and respond to security incidents. To protect data transferred on the Site through the Single Sockets Layer (SSL) protocol.
Analytics and Improvement. To analyze Site performance, user interactions and develop new features or offerings to help improve user experience on the Site.
Marketing Communications. To send newsletters or information about our services, subject to your communication preferences, and to personalize your experience. To tailor digital advertisements on Third-Party Sites based on your interests and interactions on our Site.
Legal Compliance. To respond to law enforcement requests, court orders and legal processes, and to carry out our obligations and enforce our rights.
SMS / Text Messaging. Generations uses SMS (short message service) texts for Site users if you opt-in. By opting in and providing your mobile telephone number, you consent to receive automated notifications, alerts and informational and promotional messages from Generations. Message and data rates may apply. Message frequency varies. Carriers are not liable for delayed or undelivered messages. For assistance, you may text HELP to the number from which you received the SMS text. You may “opt-out” and cancel the SMS texts at any time by texting STOP to the number from which you received the SMS text, and you will receive a confirmation message acknowledging your request. SMS data and mobile information will not be shared with third-parties or affiliates for advertising, marketing or promotional purposes.
5.How We May Share or Disclose Your Personal Data
Based on Your Direction or Consent. To third-parties, if you request or direct that we do so.
Service Providers. To vendors that provide hosting, analytics, communications or data and security services. We use third-party services and platforms to help manage, monitor and optimize our Site and services and to help measure the effectiveness of our Site, including: Google Analytics, Microsoft Clarity, NitroPack, AudioEye, Sendgrid, WordPress, WP Forms, Elementor, Google Tag Manager, Yoast, Rankmath, AI chat feature, Google Workspace, Google Search Console, Facebook Pixel or Outlook You should refer to the terms of use and privacy policies of the respective third-party services for further information regarding their use, disclosure, retention and protection of information.
Marketing and Advertising. To our advertising partners to optimize marketing.
Legal Compliance. To respond to law enforcement requests, court orders and legal processes, to comply with legal obligations, and to protect our rights, safety and property.
Business Transfers. In connection with a merger, acquisition, asset sale, reorganization or other business transaction.
Accessibility. To make the Site accessible to all users with limitations, disabilities or other difficulty accessing the Site, via AudioEye accessibility controls.
Other Business Purposes. To affiliates or subsidiaries within our practice, and to professional advisors, such as attorneys, accountants and auditors.
6.How We Protect Your Personal Data
Generations implements reasonable administrative, technical and physical safeguards designed to protect your Personal Data as processed through the Site; however, no method of transmission or storage is completely secure, and we do not guarantee absolute security from any viruses, worms or other malicious codes or destructive features on the Site. Generations is not liable for any damages or harm attributable to such features, and by accessing and using the Site, you understand that you are doing so at your own risk.
The Site may include links to Third-Party Sites. A link to a Third-Party Site is not an endorsement of the security measures on that website. By navigating to a Third-Party Site, you understand that you are doing so at your own risk and subject to the privacy policies and terms of use of that Third-Party-Site.
Generations will never request personal information, credit card information or login information via email or SMS/text messaging. If you receive an email or SMS/text message purporting to be from Generations seeking this information, you should contact our office via telephone at 203-248-4461 and/or contact law enforcement. Internet scammers and other malicious actors may attempt to harm you by pretending to be from Generations. Consistent with our Terms of Use, we are not liable for any damages or harm attributable to such attacks
Network security measures may include authentication and authorization protocols, SSL, firewalls, intrusion detection and prevention, vulnerability management and secure software development practices. Your Personal Data may also be protected by vendor and work force management such as due diligence, contractual safeguards, monitoring of staff members with access to Personal Data.
7.How We Retain Your Personal Data
Generations retains Personal Data for as long as necessary to fulfill the purposes for which it was collected, to comply with legal and regulatory obligations, to resolve disputes, to enforce our Agreement and to provide requested services to you based on your preferences. The Site will be backed up routinely. Contact form submissions through the Site are not backed up, but backups may include other Personal Data collected on the Site.
8.Effective Date and Amendment
This Privacy Policy is effective as of the “Effective Date” noted above, and it may be changed or updated from time to time. Any changes or updates will be posted on the Site and will be effective immediately upon posting.
