1.Acceptance of Terms
These are the “Terms of Use” under which you (“you”) may use the website located at https://www.generationsobgynct.com (“Site”), which is operated by Generations Obstetrics & Gynecology, P.C. (“Generations,” “we,” “our” or “us”), and which consists of information and content provided by us. By continuing to browse, view, navigate and/or otherwise use this Site, you agree to comply with and be bound by these Terms.
Nothing in these Terms replaces or supersedes any other agreement or policy between you and Generations.
2.Definitions
As used herein, “Personal Data” and “PHI” shall have the same meanings provided in our Website Privacy Policy (“Privacy Policy”).
3.No Medical Advice; Emergencies
The content on the Site is provided for general informational purposes only and is not a substitute for professional medical advice, diagnosis or treatment. Use of this Site does not create a patient-provider relationship between you and us. Always seek the advice of your physician or other qualified health provider with any questions regarding a medical condition. Do not disregard professional medical advice or delay seeking it because of something you have read on the Site. In an emergency, call 911 or go to the nearest hospital immediately. You should not attempt to access treatment or emergency care through this Site.
4.User Obligations
Eligibility. The Site is intended for use by adults and by parents or guardians on behalf of minors. We do not knowingly collect Personal Data from minors. By using the Site, you represent that you are at least the age of majority or are using the Site under the supervision of a parent or guardian.
Accurate Information. If you submit information through the Site (including contact forms), you agree to provide true, accurate, current and complete information.
Prohibited Conduct. You will not: (a) attempt to gain unauthorized access to any systems or networks connected to the Site; (b) interfere with the operation or security of the Site, including by introducing viruses, malware or harmful codes; (c) use any automated means to access the Site without our prior written permission; (d) use the Site to infringe, misappropriate or violate any intellectual property, privacy or other rights of Generations or of any person or entity; (e) submit any content that is unlawful, harmful, defamatory, obscene, harassing or otherwise objectionable; (f) use the site for any commercial, partisan, political or unlawful purpose.
5.Communications
If you contact us via the Site, you consent to receive communications from us by email, SMS/text messaging, telephone or other reasonable means, subject to your communication preferences and applicable law. You agree not to submit time-sensitive or emergency messages through the Site or sensitive information in an unencrypted format.
SMS/Text Messages. Generations uses SMS (short message service) texts for our patients and Site users. By opting in, you agree to receive notifications and alerts from Generations. Message and data rates may apply. Message frequency varies. Carriers are not liable for delayed or undelivered messages. You may “opt-out” at any time as described in our Website Privacy Policy. Text HELP to the number from which you received the SMS text for assistance. Text STOP to the number from which you received the SMS text to cancel.
6.Privacy
Your use of the Site is subject to our Privacy Policy, which describes how we collect, use, disclose and protect Personal Data. Our Privacy Policy applies to information collected online through the Site. It does not govern the collection, use or disclosure of your PHI. 7.Intellectual Property Rights
Ownership. The Site, including all text, graphics, images and other content, as well as the selection and arrangement thereof, are owned by Generations or our licensors, and are protected by appliable intellectual property laws.
Trademarks. All trademarks, service marks and logos displayed on the Site are the property of Generations or their respective owners. No right or license is granted to use any trademarks except as expressly permitted in these Terms.
Limited License. Subject to these Terms, you may access and use the Site for your personal, noncommercial use.
Restrictions. You may not copy, reproduce, modify, create derivative works from, publicly display, republish, download, store, transmit, sell, license or otherwise exploit any material on the Site without our prior written consent.
8.User Submissions
Where authorized, you may submit or upload contact information, comments, messages, reviews, feedback, appointment requests or other materials (collectively, “Submissions”) to the Site. In doing so, you represent that you have all rights necessary to provide the Submissions and that they do not violate any law or the rights of others. Such Submissions will be considered non-personal and non-confidential (except for PHI and other Personal Data, subject respectively to our HIPAA Notice of Privacy Practices and Website Privacy Policy), and you grant us a nonexclusive, perpetual, royalty-free, sublicensable and transferable license to use, reproduce, modify, distribute, display, publish and create derivative or collective works from such Submissions in connection with operating and improving the Site and our services.
If you provide feedback, reviews, comments or suggestions, we may use them without restriction and without compensation to you.
9.Third-Party Sites and Links
The Site may include links to third-party websites or services and may integrate with third-party vendors (collectively, a “Third-Party Site”). Generations does not control, own or operate any such Third-Party Site, and a link to a Third-Party Site is not an endorsement by Generations of said website, its content, its activities, its owner or its controller. The MyChart patient portal is an example of a Third-Party Site linked from our Site, but which is not owned or controlled by us. We make no representations or warranties as to the accuracy or reliability of any information contained on any Third-Party Site, or the privacy policies of any Third-Party Site, nor as to the security of any information that you may be requested to provide, or otherwise may be collected from you, on any Third-Party Site.
10.Artificial Intelligence
Artificial Intelligence (AI). AI is used in the creation, operation and/or maintenance of the Site. By using the Site, you consent to the review of any information you provide to the AI services used on the Site, including the AI chat feature (collectively, “AI Services”). Furthermore, you agree not to rely solely upon any information generated by any AI Services on the Site.
You may access an AI chat feature through the Site. The AI chat feature can respond to general questions or assist with scheduling, but its answers may not be accurate or complete. No professional medical advice will be rendered by any AI Service on the Site, and you should not attempt to use any AI Service on the Site as a substitute for professional medical advice, consistent with Section 3 of these Terms.
Generations does not control or own any AI Service on the Site. We make no representations or warranties as to the accuracy or reliability of any information provided by any AI Service on the Site, or the privacy policies of any AI Service, nor as to the security of any information that you may be requested to provide, or otherwise may be collected from you, by an AI Service on the Site. Generations does not control the information used to train or otherwise program any AI Service algorithms on the Site. Generations does not control the content generated by AI Services on the Site. If you believe that an AI Service on the Site has generated misleading, inaccurate, offensive or harmful content, you should contact Generations immediately by telephone at 203-248-4461.
11.Disclaimers
General Disclaimer. To the maximum extent permitted by law, the Site and the information and content available thereon are provided “as-is” and “as available” without warranties of any kind, whether express, implied or statutory, including warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, title and non-infringement.
No Guarantee of Security or Availability. Generations does not warrant that the Site will be uninterrupted, error-free, secure or free of viruses or other harmful components. We implement reasonable administrative, technical and physical safeguards designed to protect information processed through the Site; however, no method of transmission or storage is completely secure, and we do not guarantee absolute security from any viruses, worms or other malicious codes or destructive features on the Site. Generations is not liable for any damages or harm attributable to such features, and by accessing and using the Site, you understand that you are doing so at your own risk.
International and Out of State Use. The Site is controlled from the United States and is intended for use within the United States. Generations makes no representation that the Site is available for use in other locations. If you access the Site from outside of the United States, your information may be processed and stored in the United States where privacy laws may differ from the country in which you reside.
If you are not a Connecticut resident, certain Personal Data that Generations collects about you may be subject to your state’s consumer privacy laws.
12.Limitation of Liability
To the maximum extent permitted by law, in no event will Generations, its affiliates, officers, directors, agents, representatives, employees or assigns, be liable to you for any loss or damage, including without limitation, direct, indirect, incidental, consequential, special, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or other intangible losses, arising out of or relating to your access to or use of, or inability to access or use, the Site.
No information, content or communication published on or transmitted through the Site constitutes professional medical advice, diagnosis or treatment. The Site and the content thereon is not a substitute for professional medical advice. To the maximum extent permitted by law, Generations will not be liable to you for any loss or damage arising out of or relating to any information published on the Site.
13.Effective Date; Modifications to Terms and the Site
These Terms are effective as of the “Effective Date” noted above. We may update these Terms from time to time, and changes will be posted on the Site and effective immediately upon posting. Your continued use of the Site after any changes indicates your acceptance of the revised Terms. We may suspend or discontinue any part of the Site at any time without notice.
14.Entire Agreement; Severability; Waiver
These Terms, together with the Website Privacy Policy, constitute the entire agreement (“Agreement”) between you and us regarding the Site. If a court of competent jurisdiction finds any provision of this Agreement to be invalid or unenforceable, such finding shall not affect the validity or enforceability of any other provision of this Agreement. Our failure to enforce any provision of this Agreement is not a waiver of our right to do so later.
15.Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Connecticut.
